Judge Throws Out San Fran Handgun Ban PDF Print E-mail

Citing state pre-emption law, a San Francisco Superior Court judge has thrown out the ban enacted by the ballot initiative Proposition H passed last November.  I haven't found the full decision yet but it would be nice to see him also citing the Second Amendment as a ruling authority on the case.

Several years ago, Charlton Heston called California, "ground zero for a complete gun ban."   However, despite all the faults of the left coast and their wacky politics, at least their judges are subject to approval of the electorate.  Here in New Jersey where the governor rules with supreme authority, we have some of the most extreme leftist judges in the nation.  The NJ courts would try to overrule the Second Amendment before they'd throw out a gun ban even going.  They've even been so arrogant as to declare, "When dealing in guns, the citizen acts at his peril. "  I fear we will never get this kind of equitable defense of our civil rights by the courts of New Jersey.  If the ongoing attempt to criminalize possession of ammunition passes, I am confident the courts will uphold it as the state's prerogative.

New Jersey is indeed the new ground zero for a complete gun ban.  If the gun banners are going to be successful anywhere, it will be here and they have a healthy head start.  Where are the SAF and NRA?  What are they doing to protect our rights in New Jersey?  It is as obvious as ever that we've been forsook.
