Default Makes no sense

Have a look at this story involving this older gent. What was the crime? I just can't believe that this is the whole story, and if it is, shame on us who still allow this "unlawful posession" and "posession of unlawful"!

Yea, I thought a FID card was only needed for purchases. What if the shotgun were purchased previously by the guy when he lived in another state?

WTF? Because he had a shotgun on his own property? Exactly what was the "unlawful purpose"? I think the neighbors are the ones that need a smack for even calling the police in the first place. Where was the crime? And don't get me started on the people enforcing the laws they don't even know... There really has to be more to this story, I would be stunned if the parties involved were really this stupid. Technically he could have purchased the gun out of state without the FID if the FFL was unaware of the NJ law and didn't ask him for one. If he passed the NIC he is not on the hook for anything illegal but the FFL might be at risk as they are required to obey the laws of both states in an inter-state transfer... They must have run the shotgun and had it come back as stolen or something I really find this hard to believe with the facts provided...

This is yet another example of why you don't talk to the police... If they show up asking questions ask them for their warrant and unless provided with one tell them to have a nice day... If they came to the house and he was sitting in his kitchen with no dead bodies or a shotgun in plain sight AND he chose not to talk to them we wouldn't even know about this.

Considering court decisions indicating that the cops can't be expected to know the laws they are enforcing, he may not become rich. However, before spending money on a lawyer (assuming that there is nothing else involved here) I think he should find that section of the law that says something like "...nothing can be construed to prohibit..." Pretty much says that you don't need the card to posess in your home or to and from the range etc. (as least it did when I still lived in NJ) Then demand to face the grand jury and read the law to them. (Be careful what you say to the grand jury; you won't be able to have a lawyer with you and it can be used against you in a later trial)

It's the unlawful purpose part that is the question. We just don't know what he told the police.
